He's been granted leave to appeal by the Supreme Court.
Lundy's trying to overturn his 2015 convictions for murdering his wife and daughter in their Palmerston North home.
The decision comes just a few days after the Supreme Court heard oral submissions on the application for leave to appeal.
His lawyers argument is based around novel science being used to identify two spots on Lundy's polo shirt as human brain tissue.
A date for the appeal hearing is yet to be set.
