The man was found guilty of making unjustified breast exams at his Wellington regional practice, but is now appealing.
Despite a Health Practitioners Tribunal finding him guilty of misconduct, the man is still practising with his name a secret.
Documents obtained by Newstalk ZB show the council's lawyers have filed a cross-appeal.
It says a period of suspension is necessary to protect the public by maintaining professional standards in the medical profession.
