Brenton Tarrant's asked the Court of Appeal in Wellington, for permission to vacate his guilty pleas.
His lawyers have repeated Tarrant's assertion his prison conditions were the most oppressive in the country, and made him unfit to plead guilty.
They argue this could be a miscarriage of justice.
The panel of judges sought numerous clarifications - and expressed confusion over the crux of the argument.
The Crown will make its legal submissions tomorrow.
