Open Justice reports Mana Brown was convicted and discharged for wearing a Nomads cap at a community pool reopening in Wellington's Naenae in 2024.
Brown argued it was unfair to tar someone for wearing a cap and he should have been discharged without conviction.
Justice Christine Grice disagreed and dismissed his lawyer's suggestion the offending was harmless.
She says his past criminal history is a factor.
