Shane Claude Roberts is accused of killing 10-month-old Karlos Stephens in November 2014.
His trial was into its eighth day when Justice Muir told the jury it could no longer continue.
He said it was likely to run into a fourth week and it would have been "grossly unfair" for the jury to sit beyond the original time frame.
Criminal barrister Steve Cullen says given the High Court backlog - the case may not be recalled until mid to late next year.
