Jamie Foster was found guilty last March for the rape at a Kerikeri motel, in the early hours of February 5, 2019.
The 30-year-old was in a group deployed to Waitangi Day events at the Treaty Grounds.
After the assault, Foster called then Commissioner, Mike Bush.
The call was mentioned during his challenge of his convictions in the Court of Appeal last November.
Today, the Court of Appeal released its decision to dismiss Foster's appeal.
Police are yet to release any information about the phone call.
