Malachai Scott Roger Wylie was arrested in April after allegedly sniffing, spitting, and performing sex acts in workers shoes, then posting the evidence online.
Judge Russell Collins says Wylie has had already suffered significant punishment, including publication of his name.
His mental health and lack of prior convictions played heavily into the judge's decision.
Wylie has already tried to seek help for his mental health, and Collins says he didn't want to further impact his life.
